Parliament Debates Yoke Shan's Case


During the committee stage of the debate for Ministry of Health, Parliamentary Opposition Leader, YB Lim Kit Siang (DAP-Ipoh Timur) touched on negligence of public hospital which has been highlighted recently by various media report, i.e. Baby Yok Shan left arm amputation.

在卫生部委员会阶段辩论时,国会反对党领袖兼民主行动党怡保东区国会议员林吉祥严厉抨击政府医院的医疗疏忽问题,并提出小钰珊所遭遇的不幸疏忽事故。

Minister of Health: Mistakes are Inevitable

The Minister of Health has irresponsibly given a blank cheque to hospital doctors and authorities to make mistakes and be negligent. By accepting that mistakes are "inevitable", he'll only be letting weak and negligent doctors get away with it.

Parliamentary Opposition leader, Sdr Lim Kit Siang wrote on his blog:
The Health Minister, Datuk Seri Dr. Chua Soi Lek’s statement in the press yesterday that “medical mistakes are inevitable” however careful the doctors are is most regrettable and must be deplored by all MPs as it is tantamount to giving a blank cheque for hospital negligence endangering lives and welfare of the people seeking medical treatment.

We claim to want to be a first-world developed nation which is not matched by a first-world mentality and mindset, such as making an important distinction between mistakes and negligence in hospital. The former is understandable and acceptable but the latter, i.e. negligence, is totally unacceptable and unforgivable.

Tragic cases like the baby girl Lai Yok Shan who lost her left forearm because of a chain of negligence at the Tengku Ampuan Rahimah Hospital in Klang or a private hospital nurse Kalaiyarasi Perumal, 44, who went through the nightmare of a pair of forceps left in her abdomen after an operation at the Sultan Aminah Hospital in Johor Baru cannot be accepted as unavoidable incidents.


Tragedy is only waiting to happen to you.

RM2 Million Compensation Suit


Baby Yok Shan has received a letter from the Government stating the amount of compensation the Government was willing to offer. Her lawyer, DAP Selangor Legal Bureau Chief, Lim Lip Eng informed her parents of the offer last Friday. However, the offer clearly fell short of expectations and fail to take into account the full impact on Baby Yok Shan and her future.

As a result, together with DAP National Legal Bureau member, Gobind Singh, Baby Yok Shan's father filed a RM2 million plus suit against the Goverment, the Hospital as well as the two negligent doctors for compensation. The above video was taken at the press conference after we filed the suit. At the same time, the DAP announced the blog to let the public gain greater awareness of the case.

(沙亞南訊)被逼斷臂保命的小鈺珊父母,週五(30日)通過哥賓星律師和林立迎律師,入稟沙亞南高庭,起訴4造要求200萬令吉賠償。

4名答辯人是見習醫生、主診醫生、巴生中央醫院院長和大馬政府。有關賠償包括一般賠償、嚴重性賠償、懲罰性賠償、特別賠償、法官認為合理的賠償及堂費。

哥賓星在週五下午約4時入稟時對記者說,第一和第二答辯人沒有名字,不過,他們會在入稟後,向法庭申請庭令,要求院方提供兩名醫生的名字。

甫出世17天女嬰黎鈺珊,疑因醫生吊點滴時疏忽,刺破血管而導致左手前臂壞死。女嬰黎鈺珊,她的父親黎建奇(24歲)和母親娜天杜虹(27歲),以及公公和婆婆,週五都有到法庭。

Baby Yok Shan Returns Home


Baby Yok Shan is discharged from hospital this morning. Today we are also celebrating the Chinese Mid-Autumn Festival, which makes this reunion a doubly significant one for Yok Shan's parents and family.

She left HTAR around 12.15pm. Compared with newborn weight of 1.75kg, Yok Shan's weight has now reached 3kg. Her amputated arm has partially recovered..

小钰珊今早,也是适逢中秋节出院。父亲黎建奇对能在中秋节人团圆的佳节与女儿一家团聚感到非常开心。

小钰珊是在约中午12时15分出院,比较起出世时体重只有1.75公斤,小钰珊目前的体重已增加至3公斤。其截肢部分复原状况良好,呈“M”状,因为两边的伤口已经生肉,只剩下中间的部分还须继续清洗。

黎建奇明天还要带小钰珊前往复诊,让骨科医生检验,并每两天便要带小钰珊回到医院,清洗伤口直到复原为止。

小钰珊出院过程还算顺利,只是院方原本允许他们在小钰珊出院前拆开纱布,检视小钰珊的伤口。但当黎建奇要求院方让我(陈彼得)陪同见证时,却遭对方拒绝,并连父母都不获准查看。

还好黎建奇据理力争,更挑战他们是不是怕什么,才不敢拆出让我们看。该名医生才准许小钰珊的父母、妻子与家人检视女儿的伤口。而我还是被拒于门外。

Request for Compensation

Legal counsel for baby Yok Shan wrote to the Minister of Health, Datuk Chua Soi Lek stating that the loss of baby Yok Shan's left arm is due to carelessness and negligence of the medical officers at Tengku Ampuan Rahimah Hospital.

The letter seeks compensation from the Malaysian government for the loss of limb.

信函内容:

由于院方疏忽导致女婴黎钰珊失去前臂事件,我们代表原告,即女婴的父亲黎建奇与母亲娜天杜虹,希望院方能在两周内,以文字答复以下问题:

(1)给予原告的赔偿金数额。

(2)何时才会移交赔偿金给原告。

(3)卫生部是否答应承担小钰珊一切医疗费、教育费及安装义肢终生的医疗费用。

另一方面,小钰珊的父亲也发表声明,指责巴生中央医院院长雅哈亚医生通过报章指出,院方教导妻子为女儿清洗伤口,但是根本没有此事,院长在说谎。

此外,雅哈亚也通过报章说,他的女儿没有受到细菌感染,但是来自梳邦的专科医生周三拿出有关的检验报告,让黎建奇过目,并解释小钰珊的伤口处受到细菌感染,血液则没有受到影响。

Incompetence?

小钰珊今日进行截肢手术,让我感到最痛心的是小钰珊坏死的左手部分竟然腐化至医生还未动刀,一扭便自动脱落,而主治医生之前竟浑然不知,还告知父母整个手术过程需耗时4个小时!

这显示出医院平时根本没有给予小钰珊仔细的检查,也不清楚小钰珊坏死左手的腐化程度已如此严重。我也对卫生部长拿督蔡细历之前表示将派出医生每天专门监督小钰珊情况的谈话,感到失望,因为以目前的情况来看,这根本是说一套,做一套。

原本预算4小时的小钰珊截肢手术,医生还未动刀,一扭便已自动脱落,仅5分钟便已戏剧性完成整个截肢手术。 目前院方并没有为女儿的伤口缝合,医生只是清洗伤口,并指伤口将自然愈合。

至于坏死部分是否会蔓延,医生说断肢部位有些发炎,还须观察两星期。

我呼吁,卫生部必须为医院的疏忽负责,包括为小钰珊安装义肢,以及负责医药费等。然而至今小钰珊的父母还未接获有关安抚金与赔偿的通知。对此行动党的律师将极力争取,倘若卫生部没有任何的表示,我们将协助小钰珊采取法律诉讼行动。

此外,更令人惊讶的是巴生中央医院昨晚在为小钰珊母亲抽血时,竟然再度插错血管。根据小钰珊母亲说,医院为了以备今日女儿动手术之需,而为她抽血。

但是第一次插血管时却因为插错血管,没有血液流出,之后才另行插过。医院根本没有吸取之前的教训,反而一再出现疏忽。

国会反对党领袖林吉祥将于星期一将此事带入国会讨论,为小钰珊讨回一个公道。

Shocking Revelation!

Case 1:

9am Surgery to begin.Duration of the surgery was estimated about 4 hours.

9.30am Two doctors went into the surgery theater.

10am The two doctors came out. They explained that no surgery was needed on Yok Shan's hand. Her rotten hand came off just by a slight twist. The whole procedure took less than 5 minutes.

Case 2:

Yok Shan's mother had the same horrifying experience yesterday. Needle inserted into her vein the first time but drew no blood. The mother's blood was meant to be used for Yok Shan's surgery in the event of an emergency.

Opposition Leader Lim Kit Siang will bring out this issue on Monday Parliament.

Yok Shan to lose her arm

KLANG: One-month-old baby Lai Yok Shan will undergo an operation to amputate her left arm on Saturday. Tengku Ampuan Rahimah Hospital director Dr Yahya Baba said the amputation would be below the elbow.

The forearm of Lai Yok Shan which has turned black. He said doctors involved in the operation explained the procedure to Yok Shan's parents last night. Yok Shan was born premature and her arm became infected while she was placed in an incubator.

At a press conference organised by Pasar Besar DAP branch chairman Peter Tan earlier, Yok Shan's father Kian Khee had called on the hospital to conduct the operation as his daughter could no longer bear the pain.

“My daughter is not a guinea pig, stop torturing her. It is painful to see her in this condition, we just want her safe,” said the 24-year-old mechanic.

He also said that he did not need the ex-gratia payment offered as compensation to the family by the government as it was meaningless since Yok Shan's arm could not be saved.

“We just want the hospital to bear the medical expenses for all the treatment she will need and for as long as she will need it. We also want the hospital to provide an artificial limb for her, for as long as she lives. We don’t want to see her going to school without an arm,” he said.

Kian Kee claimed that he had been left in the dark over Yok Shan's condition and received conflicting reports.

“I found out (about the condition) through the media or when reporters called me for comments,” he said.

The family's lawyer Lim Lip Eng said the family would accept an apology from the houseman who treated Yok Shan as it was not his or her fault but was misguided or given the wrong training.
